GDPR and data rights

GDPR policy for HypeVideo.

This policy explains how SaaS Cloud LLC addresses data-protection rights under the EU GDPR, UK GDPR, and related laws for HypeVideo.

1. Who we are

SaaS Cloud LLC (“SaaS Cloud,” “we,” “us,” or “our”), a company in the United States, operates HypeVideo at hypevideo.co. SaaS Cloud LLC is the parent company behind MagicActors and Bougie Video. Those products may publish separate privacy notices or product terms for the information they process.

2. Scope and roles

This policy applies to personal information collected through HypeVideo, including the website, support conversations, and any HypeVideo service that links to this policy. It explains our approach for people in the European Economic Area, the United Kingdom, Switzerland, and other locations whose data-protection laws provide similar rights.

For information SaaS Cloud collects for its own purposes, SaaS Cloud is generally the controller. If a SaaS Cloud service processes personal information on behalf of a business customer under that customer’s instructions, the customer may be the controller and SaaS Cloud may be a processor. Product-specific terms or a data-processing agreement may provide additional details.

3. Information we may process

Information you provide

Depending on the HypeVideo feature you use, we may receive your name, email address, company, support request, feedback, survey response, or other message content. If a HypeVideo service supports an account or content upload, we may also process the account details, prompts, scripts, files, images, audio, video, and generated outputs needed to provide that service.

Information collected automatically

Our hosting, security, and measurement systems may record technical information such as your IP address, browser and device type, operating system, referring page, requested URL, date and time, approximate location, interaction events, and basic server-log information.

Transactions and communications

If you purchase or subscribe to a service, payment providers may process payment tokens, billing details, transaction history, and fraud-prevention signals. We may retain support emails, account correspondence, and records of privacy requests.

4. How we use information

We may use information to provide, maintain, secure, troubleshoot, and improve HypeVideo; authenticate users and manage accounts; process payments and prevent fraud or abuse; operate AI-assisted features; respond to support requests; understand website and product usage; communicate service or security notices; comply with legal obligations; enforce agreements; and establish or defend legal claims.

Where permitted and with consent when required, we may also send product updates or marketing communications. You can opt out of marketing messages using the unsubscribe option or by contacting us.

5. Legal bases

Where the GDPR or another applicable law requires a legal basis, we rely on the basis that fits the activity. This may include performance of a contract or requested service, our legitimate interests in operating and securing the website and services, compliance with a legal obligation, and consent for activities such as certain non-essential cookies or marketing. Where processing is based on consent, you may withdraw consent at any time, although withdrawal does not affect processing that occurred before withdrawal.

6. AI-assisted processing

Some HypeVideo-related services may process prompts, files, scripts, media, and generated outputs to provide an AI-assisted workflow. Unless a product-specific notice, contract, or user choice says otherwise, customer content is processed to provide the relevant service and is not used to train a foundation model without an opt-in or contractual instruction.

Some features may generate, transform, or rank content automatically. You should review AI outputs for accuracy, rights, product claims, people, captions, and other risks before using them. If a product uses automated decision-making that produces legal or similarly significant effects, the applicable product notice will explain that processing and the rights available under applicable law.

7. How we share information

We may share information with service providers that help us host, secure, operate, support, measure, communicate through, or provide infrastructure for HypeVideo and related services. These providers may include hosting, email, analytics, payment, customer-support, security, and AI or model-infrastructure providers. We require appropriate confidentiality and data-protection commitments for their role.

We may disclose information when required by law, to protect the rights, safety, and security of users or SaaS Cloud, to investigate fraud or abuse, or in connection with a merger, acquisition, financing, or transfer of all or part of our business. We do not sell personal information.

8. International transfers

SaaS Cloud and its service providers may process personal information in the United States and other countries that may have different data-protection rules from your own. Where required, we use appropriate safeguards for international transfers, which may include the European Commission’s Standard Contractual Clauses, the UK International Data Transfer Addendum, and supplementary measures.

9. Data retention

We retain personal information only for as long as reasonably necessary to provide the relevant service, maintain security, respond to support requests, meet legal obligations, resolve disputes, enforce agreements, and support the purposes described in this policy. Retention periods may differ by product, workspace, content type, and service provider. Product-specific notices or terms may provide more precise retention details.

10. Your GDPR rights

Subject to applicable law and its conditions, you may have the right to:

  • request access to the personal information we hold about you;
  • request correction of inaccurate or incomplete information;
  • request deletion of your personal information;
  • request restriction of certain processing;
  • receive or ask us to transfer certain information in a portable format;
  • object to processing based on legitimate interests or to direct marketing; and
  • withdraw consent where processing is based on consent.

If SaaS Cloud processes your information for a business customer, we may refer your request to that customer or assist the customer in responding. We may need to verify your identity before completing a request. You also have the right to lodge a complaint with the data-protection supervisory authority in your country, place of work, or place where you believe an infringement occurred.

11. Cookies and measurement

HypeVideo uses cookies and similar technologies for functionality, security, preferences, and measurement. Where applicable law requires consent for non-essential cookies, we will request consent before enabling the relevant technology and respect your choice. You can also control cookies through your browser settings.

HypeVideo may use Google Analytics 4 to understand how visitors find and use the website. We do not intentionally send names, email addresses, passwords, API keys, private prompts, scripts, uploaded media, or other directly identifying content to Google Analytics. 12. Security

We use reasonable administrative, technical, and organizational measures designed to protect personal information, including access controls, security monitoring, encryption where appropriate, and least-privilege practices. No transmission or storage system is completely secure, so do not send passwords, API keys, or unnecessary sensitive information through a general support message.

13. Children

HypeVideo is not directed to children under 16, or a higher minimum age where required by local law. We do not knowingly collect personal information from children. If you believe a child has provided information to us, contact us so we can investigate and take appropriate action.

14. Changes to this policy

We may update this policy as HypeVideo, related services, data practices, or legal requirements change. We will update the “Last updated” date when we make changes. Where required, we will provide additional notice or obtain consent for material changes.
