1. Overview of Service
HypeVideo is a software product that enables users to create AI-generated UGC videos, AI twin videos, AI avatar videos, and faceless videos. The product is offered as a one-time purchase and operates on a Bring Your Own Key (BYOK) model — you supply your own API keys from third-party providers such as Fal.ai to power AI features.
2. Eligibility
You must be at least 18 years old to purchase and use HypeVideo. By using our product, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Purchase & License
Upon completing your one-time purchase, you are granted a non-exclusive, non-transferable, revocable license to use HypeVideo for personal or commercial purposes, subject to these Terms. This license does not grant you ownership of the software or any intellectual property rights.
- You may not redistribute, resell, sublicense, or share your copy of HypeVideo with others.
- You may not reverse-engineer, decompile, or disassemble the software.
- You may not use the product for any illegal or unauthorized purpose.
4. Bring Your Own Key (BYOK)
Important: HypeVideo does not provide AI processing services directly. You are required to supply your own API keys from third-party providers. You are solely responsible for all costs, compliance, and terms of service associated with your use of those third-party APIs.
- Your API keys are stored locally on your device. We do not collect, store, or have access to your API keys.
- You must comply with the terms of service of each third-party API provider you use.
- HypeVideo is not responsible for any charges, restrictions, or actions taken by third-party API providers.
5. User Content & Responsibility
You retain ownership of the content you create using HypeVideo, subject to any applicable third-party API provider terms. You are solely responsible for:
- Ensuring your content does not violate any laws, regulations, or third-party rights.
- Obtaining necessary permissions for any likenesses, voices, or media used in your videos.
- Complying with applicable deepfake, AI disclosure, and synthetic media laws in your jurisdiction.
- Any consequences arising from the distribution or use of your AI-generated content.
6. Acceptable Use
You agree not to use HypeVideo to:
- Create content that is defamatory, harassing, threatening, or promotes violence.
- Generate non-consensual intimate imagery or deepfakes of individuals without their consent.
- Produce content intended to defraud, deceive, or mislead others.
- Create content that infringes on intellectual property, privacy, or publicity rights.
- Violate any applicable local, state, national, or international laws.
We reserve the right to terminate your license if we become aware of any violation of these terms.
7. Intellectual Property
HypeVideo, including its design, code, features, branding, and documentation, is the intellectual property of HypeVideo and is protected by copyright and other intellectual property laws. Your purchase grants you a license to use the product — it does not transfer ownership of any intellectual property.
8. Limitation of Liability
To the maximum extent permitted by law, HypeVideo and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
- Your use or inability to use the product.
- Any content created using the product.
- Third-party API service interruptions, charges, or policy changes.
- Unauthorized access to your data or API keys.
- Any errors, bugs, or inaccuracies in the software.
Our total liability shall not exceed the amount you paid for the product.
9. Disclaimer of Warranties
HypeVideo is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the product will be uninterrupted, error-free, or compatible with all systems or third-party services.
10. Modifications to Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of HypeVideo after any modifications constitutes your acceptance of the revised Terms.
11. Termination
We may terminate or suspend your license at any time, without prior notice, if you breach any of these Terms. Upon termination, you must cease all use of HypeVideo and destroy any copies in your possession.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Sheridan, Wyoming.
